Acquisition of original title to grant/license land

If an heir is named after the death of the grantee/licensee and the spouse, then the successor or the heir by consanguinity under sub-section 111 can acquire the original right.

                Documents to be provided by you for this

Original rights claim letter
Death Certificates of Grantee and Spouse (attested copies issued by Additional District Registrar)
Applicant's birth certificate (to confirm kinship)
Transcript obtained from the office of the Land Registrar (must be obtained within 03 months)
Original offer sheet and 2 photocopies
Affidavits in case of differences in names and surnames
Three stamps of Rs.25.00 for registration of original title at the land registrar's office

  • In order to give the original right to a land named after your name, the grantor and the spouse must have entered into the enjoyment of the land within 06 months of their death.
  • If your right is an offer letter, after providing the relevant documents, it will be sent for registration at the land registrar's office.
  • After registering and coming to us, after notifying you in writing, the applicant can bring the original right certification document along with the national identity card.
  • The original license will be returned to you after the designation of original ownership in the name of the license is recorded on the license and in the ledger.

 

Acquiring ownership of a deed under the Land Development Ordinance

What are the differences between a deed and a license?

 

 License is a temporary document
 It is conditional. Violation of conditions may result in cancellation of license.
 A measuring tape is attached to the permit.
 The license is signed by the Divisional Secretary.
 His Excellency the President has signed the deed.
 Therefore, the ownership of the land is fully owned. (Subject to insurance terms and conditions)

The Land Officer/Janapada Officer will also inspect the land and give a certified report to the Divisional Secretary that the land has been developed by you.
The divisional secretary gets the survey department to measure the land and get the boundary stones.
 After receiving the Pimbura, the deed is prepared by the Divisional Secretary and sent to the Land Commissioner General by the Provincial Land Commissioner.
 After receiving the deed with the countersignature of His Excellency the President and the signature of the President's Secretary, it will be sent to the Divisional Secretary.
The Regional Secretary will inform you to pay a service charge of Rs.100.00 for the deed.
You should act to pay the amount promptly.
Then the Divisional Secretary will register the deed and give it to you.

A bank can mortgage your settlement deed when you need to get a loan to develop your land or repair your door.
Your child can be pledged for a loan.
Court can grant bail.
